Limited Warranty
J. Pierski Enterprises LLC dba Charmac Trailers (hereinafter referred to as “Charmac”) warrants to the original retail purchaser (hereinafter referred to as the “Purchaser” or “Owner”) that its products will be free from defects in materials and workmanship arising from normal use, for the terms set forth below.
WARRANTY COVERAGE
Three (3) Year Warranty:
· Atlas Cargo, Escape, Race Sport, Snow Sport, Standard Duty, Stealth Cargo, Tri-Sport
Seven (7) Year Warranty:
· Commercial Duty, Legend
This Limited Warranty covers the main frame structure, consisting of the bottom rail, floor crossmembers, side posts, roof rail, and subframe only. All other components or materials supplied by third-party vendors to Charmac are warranted for one (1) year from the date of purchase. The following specific components are covered for one (1) year from the date of purchase: (i) aluminum welds; (ii) hardware, including hinges, nuts, bolts, and similar fasteners; and (iii) latches.
Charmac trailers are also guaranteed not to leak under normal use for a period of one (1) year from the date of purchase.
To maintain optimal performance and prevent leaks after the warranty period, Charmac recommends applying an RV roof coating to all seams annually and regularly inspecting all weather-stripping for wear or damage.
THIRD-PARTY COMPONENTS
Parts and equipment such as tires, axles, brake components, suspension components, couplers, jacks, casters, mats, batteries, windows, doors, and any other auxiliary parts supplied by third-party manufacturers are not covered by this Limited Warranty. Such items are covered exclusively under their respective manufacturer warranties.
COMMERCIAL USE
Trailers used for commercial purposes are covered under a one (1) year warranty and are not eligible for the standard consumer warranty specified above.
SPECIFIC ADDENDUM — GLUED EXTERIOR SHEETING
For any Charmac trailer upgraded to Glued Exterior Sheeting will be subject to the following additional terms. In the event of delamination, Charmac agrees, at its sole discretion, to use an approved Applied
Products repair kit to re-laminate the seam of the exterior sheet and/or refasten the entire trailer using screws or rivets, as determined by Charmac or its authorized dealer.
EXCLUSIONS AND LIMITATIONS
This Limited Warranty covers only defects in materials or workmanship arising from normal consumer use. It does not apply under any of the following conditions:
1. Misuse or Neglect: Misuse, abuse, negligence, accident, overloading, improper loading or attachment, or failure to perform reasonable maintenance.
2. Unauthorized Modifications or Repairs: Any alteration, modification, or repair not expressly authorized in writing by Charmac.
3. Improper Use: Use of the trailer for rental, lease, or commercial purposes without prior written approval from Charmac.
4. Exceeding Weight Ratings: Loading or towing in excess of the Gross Vehicle Weight Rating (GVWR) or hitch weight limits as stated on the certification label.
5. Improper Towing: Towing with a vehicle rated at more than twice the trailer’s listed hitch weight unless equipped with an air-ride suspension system.
NORMAL WEAR AND MAINTENANCE
This Limited Warranty does not cover normal wear items or cosmetic deterioration, including but not limited to tires, brakes, brake linings, bearings, lights, flooring, paint, corrosion, batteries, scratches, dents, tears, or other surface blemishes. Routine maintenance, adjustment, and upkeep are the sole responsibility of the Purchaser.
WARRANTY VOIDANCE
Any misuse, neglect, or failure to maintain the trailer in accordance with recommended practices shall discharge Charmac from all obligations under this Limited Warranty. The provision of service, authorization of repairs, or any other attempt to assist with a warranty claim shall not constitute a waiver of Charmac’s rights.
EXCLUSION OF CONSEQUENTIAL DAMAGES
This Limited Warranty excludes all liability for consequential, incidental, or secondary damages, including but not limited to loss of use, inconvenience, or rental costs; towing or transportation expenses; or lost income or other indirect losses
PRIOR CONSENT REQUIREMENT
No reimbursement will be made to any dealer or owner for repairs made without prior written approval from Charmac.
Photographs or physical samples of defective parts may be required for approval. All defective parts must be shipped to Charmac freight prepaid to qualify for warranty consideration.
TRANSPORTATION COSTS
Purchaser shall deliver the trailer for warranty service within a reasonable time after discovery of any defect and no later than the expiration of the applicable Warranty Period. All transportation, freight, and associated costs to and from the factory or service center are the sole responsibility of the Purchaser and are not covered under this warranty.
WARRANTY CLAIM PROCEDURES
Any trailer with a potential defect covered under this warranty must be returned to an authorized Charmac dealer or directly to the Charmac factory for inspection. Repairs or adjustments may be made only after obtaining prior written approval from Charmac. All approved repairs must be performed by an authorized Charmac dealer, a Charmac-approved repair facility, or the Charmac factory.
LIMITATIONS OF LIABILITY
Charmac’s sole obligation under this warranty is limited to the repair or replacement of defective parts, as determined by Charmac in its sole discretion. No expenses or claims related to warranty repairs will be covered without prior written authorization. Charmac is not responsible for any consequential, incidental, special, or indirect damage resulting from defects in materials or workmanship, including but not limited to loss of time, income, property damage, or personal injury. Charmac reserves the right to modify or improve any product covered under this warranty without obligation to retrofit previously manufactured units. Charmac makes no other express or implied warranties, including but not limited to warranties of merchantability or fitness for a particular purpose. Any implied warranties that may arise under state law are expressly limited in duration to the term of this Limited Warranty.
EXCLUSIVE REMEDY
The purchaser’s exclusive remedy for any breach of warranty shall be limited to the repair or replacement remedies expressly stated herein. Any action for breach of warranty must be commenced within the applicable warranty period. Charmac neither assumes nor authorizes any person to assume on its behalf any other obligation or liability in connection with this product.
WARRANTY REGISTRATION REQUIREMENT
A completed copy of this warranty, electronically signed and acknowledged by an authorized Charmac dealer, must be submitted through the official Charmac portal no later than ten (10) business days from the original date of purchase. Failure to submit a properly completed warranty registration through the portal within ten (10) business days of purchase will void all warranty coverage.
DEALER NOTICE
By submitting this Manufacturer’s Warranty through the official Charmac portal, the undersigned dealer certifies that the purchaser has been fully informed of, and has had explained to them, all applicable warranty terms, conditions, and claim procedures; and a copy of this warranty has been provided to the purchaser in printed form or by means of a QR code.
